A new news has come for those who have been working temporarily i.e. on contract for the last several years. Recently an important decision has been given by the Supreme Court, according to which it has been said that it has now become necessary to provide facilities like government jobs to the employees working on contract for a long time.
We want to tell you that pension and allowance, gratuity and most importantly permanent job have also been included in it. This decision seems to be no less than a boon for contract employees, especially for those who have been working regularly for the last several years and after that have been put in the name of contract.
Know the order of the Supreme Court
First of all, let us tell you that this case started with just one petition, in which the contract employees working in the state government department appealed to the court to make them permanent. All these employees had worked for an estimated 10 years without stopping but despite this, they were not getting permanent jobs or facilities.
During the hearing, the Supreme Court has clearly stated that it is not fair to keep an employee on hold for many years in the name of contract. If an employee is working like a temporary employee, then he should be given the same salary as well as allowances and other facilities. The court has considered this a violation of Article 14 of the Constitution, i.e. the right to equality.
Who are contract employees?
People who are kept for a fixed time for any work are called contract employees. Contract employees work temporarily in the department and these people do not get the facilities which are given to government employees. But if we talk about reality, the work that government employees do is also done by contract employees. Sometimes contract employees work harder than government employees, yet they do not get their rights.
What will happen after the decision?
After this decision of the Supreme Court, all the contract employees who meet the prescribed standards will be able to avail the following facilities:-
- get a permanent job
- You will get the benefit of pension
- dearness allowance
- Also get the benefit of gratuity and paid holidays.
- Facilities will be provided like other government employees.
Who will benefit from this decision?
You must be well aware that there are more than 30 lakh people in our country India who are service workers, they are working in various departments – for example as teachers in schools and health workers in government hospitals and other posts like clerks and computer operators. If any of these employees is working continuously for 5 years or more and is of a less permanent nature, then he will get the benefit of this decision.
